Council Member Pool met with City Clerk Jannette Goodall this week to discuss inconsistencies in the Code regarding the size and nomination process for the Downtown Commission. The Clerk’s Office has since requested an item be placed on the November Audit and Finance agenda for discussion and possible action on Code changes for Chapter 2-1 relating to the Downtown Commission to address the conflicting language in Chapter 2-1-140 (Downtown Commission).

Below is a summary of the three options the City Clerk will present to the committee:
1. In Section A – strike 15 members and replace it with 19 members.
2. In Section A(1) – strike “and each council member may” and replace it with “The mayor nominates 7 members to be appointed by the Council.”
3. In Section A(1) – strike “The mayor and each council member may nominate one commission member to be appointed by the council.”’; and replace it with language that allows the following Council Committees to each nominate one commission member to be appointed by the council (Audit & Finance, Economic Opportunity, Health and Human Services, Mobility, Open Space, Planning & Neighborhoods and Public Safety).

Here is the section of the Code in question:
§ 2-1-140 - DOWNTOWN COMMISSION.

(A) The Downtown Commission is composed of 15 members appointed by the city council. If no more than the number of members necessary to provide a quorum of the Downtown Commission is present at a meeting, a board action is adopted by an affirmative vote of two-thirds of the quorum. If more than a quorum is present at a meeting, a board action must be adopted by an affirmative vote of the number of members necessary to provide a quorum.

(1) The mayor and each council member may nominate one commission member to be appointed by the council.
