CORRECTED ITEM 93 eTOD Amendment Kitchen

Thank you to MPT Harper-Madison for accepting most of my amendments to Item 93 eTOD Resolution.

I have one remaining amendment - that tracks back to our conversations at the worksession on June 1st. As we discussed at the worksession, this amendment clarifies where land use amendments would be relevant given the CapMetro study area (see rationale below).

I am hopeful this amendment is acceptable to the Mayor Pro-Term. As we have been discussing, this resolution is a useful and important step to improving our TOD ordinance and working with CapMetro to support equitable transit opportunities in Austin.

Item 93 eTOD Resolution, Amendment to Line 142:

BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUSTIN:
The City Council directs the City Manager to contribute actively to the ongoing studies, in partnership with Capital Metro, to help ensure the study outcomes serve as a guide for revising the City’s existing TOD process and station area plans, as well as providing recommendations to initiate relevant land use amendments in the eTOD Study area and areas designated as TODs. <<<. DELETE: and high-capacity transit areas>>>

RATIONALE: The amendment clarifies “where” land use amendments would be relevant given that the CapMetro studies are for specified geographic areas. The CapMetro studies are specific to a geographic area. That could be relevant to other TODs, depending on the context for other TODs, but would not be relevant to all areas in the city with some transit service.

I appreciate your extensive collaboration on this resolution thus far, Council Member Kitchen.

However, I worry that the proposed amendment is too limiting.

I would be willing to replace "and high-capacity transit areas" in my original language with "and along Project Connect’s Metrorapid, Metrorail, and light rail lines.”

The reasoning here is that the two most competitive Metrorapid lines did not score well with the FTA when CapMetro sought funding for them due to issues this resolution seeks to address.

The recommendations this resolution calls for will hopefully strengthen other Metrorapid lines, including the Menchaca/Oak hill extension of the 803, when Capital Metro applies for federal help to build them.

Additionally, allowing the scope to include corridors further from the core expands our opportunities to equitably include more residents from communities that have long been excluded from these conversations and the opportunities that affordable access to quality transit provides. I think it’s important to reiterate this resolution is not initiating any changes. We are only asking staff to bring back recommendations for us to deliberate upon in the future, and I believe it’s worthwhile and more equitable to allow these areas to at least be part of the conversation.

Thank you MPT Harper-Madison for considering this amendment. I believe the substitute language that you have suggested would address my concern and give staff the appropriate direction to focus resources on the highest priority corridors as they proceed with ETOD policy development, community engagement, anti-displacement efforts, and land use planning and recommendations.
