Item 32 Pilot Knob PUD

Council members,

Tomorrow, we (Adler, Casar, Garza) intend to offer an amendment to the Pilot Knob PUD ordinance, item #32, to not specify a funding mechanism for the owner-occupied affordable housing, and instead to keep this issue open pending further Council consideration and action, following review and recommendation by City staff and discussion with the Landowner. This amendment would ensure and protect at least the Landowner’s obligation to provide the owner-occupied affordability at “first sale” as contained in the MUD Consent Agreements, but would give us time to see if there are alternatives that would receive subsequent and future Council approval to enable providing permanent owner-occupied affordability, such as future consideration of any waivers of or exemptions from fees.

In the ordinance in back up, it will be suggested to replace Part 8(B) with the attached language. The new language is underlined; the remaining language is as proposed in back-up, but with the legislative formatting removed for ease of reading. It is also suggested to delete Part 12(H) (2) (allowing for Capital recovery fee waiver) as this concept is included elsewhere as a possible option for consideration.
